Did Joe Biden breach "Logan Act Law"?


When Gen. Michael Flynn was investigated under the so-called Logan Act and eventually had resign after he allegedly had “conversations” with foreign leaders during the transition period between Obama and President Trump? You may recall that at the time Flynn had these conversations, he had already been named as Trump’s National Security Adviser for the upcoming administration.

our surprise when Ben Rhodes, former deputy national security adviser during the Obama Administration claimed on Nov 9th that “foreign leaders are already having phone calls with Joe Biden.” Odd…isn’t that exactly what Flynn was investigated for?

If we’re being consistent, Joe Biden has not been confirmed as the president elect, the votes have not been certified, and there is ongoing litigation. Using the same criteria the Democrats used in 20, wouldn’t what Biden is doing be illegal?

In fact, it was Biden himself, who suggested in a White House meeting in early 20 that Flynn may have been in violation of the Logan Act, which bans civilians from engaging in talks with foreign leaders.

Since Biden is not yet, in fact, the president elect, he is a civilian. Although the Obama administration officials deny that Biden made the suggestion, information obtained by U.S. Attorney John Durham seem to contradict that.

On MSNBC Nov 9th, Rhodes admitted Biden was in discussions with foreign leaders concerning “the agenda they’re going to pursue January 20th.”

Rhodes spouted off while condemning President Trump for contesting the results of last week’s bizarre election.

P.S. The Logan Act (enacted January 30, 99) is an U. S. federal law that criminalizes negotiation by unauthorized American citizens with foreign governments having a dispute with the United States.

Fox News host Sean Hannity on Nov 11, night equated President-elect Joe Biden fielding congratulatory calls from world leaders after his election victory to former National Security Adviser Michael Flynn discussing sanctions with Russian leaders during the Trump transition.

In recent days, Republicans and Trump allies have taken issue with Biden speaking to foreign leaders following his victory over President Donald Trump last week. Specifically, they have raged over former Obama Deputy National Security Adviser Ben Rhodes saying the president-elect is already “having phone calls” with leaders to discuss “the agenda they’re going to pursue” in the Biden administration.

“Hypocrisy, double standards, outright lies on full display again tonight because, get this, failed Obama adviser Ben Rhodes revealing this week that Joe Biden is already talking to foreign leaders like the French President Macron,” Hannity grumbled on 11/11/2020 night. “And, wait a minute, Michael Flynn had what was a customary call with the Russian ambassador, soon to be counterpart, in 2016.”

“He was the incoming national security adviser, and all we heard about from the fake news, fraudulent media mob was this could be a violation of the Logan Act,” the Fox host continued. “And by the way, that was a law from 1799 that has never successfully been used to prosecute anyone.”

The Logan Act was passed in 1799 with the intent to prevent unauthorized American citizens from negotiating with foreign governments over disputes with the United States. While violation of the act is a felony, only two people have ever been charged under it and none convicted.
